Terms of Service
These Terms of Service ("Terms") govern your use of GrailHound — our websites, web app, and mobile apps (the "Service") — operated by SentoWeb Srl, a company registered in Romania ("GrailHound", "we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it. You are responsible for your account and for keeping your credentials secure; notify us promptly of any unauthorized use.
2. What GrailHound does
GrailHound lets you create "trackers" that monitor selected third-party marketplaces for newly listed items matching your criteria, and notifies you of matches via the feed, email, push, and/or webhooks. Checks run on a schedule; we do not promise real-time or instantaneous discovery, complete coverage of any marketplace, or that any particular item will be found or still be available when you act on it.
3. Marketplaces and third-party content
GrailHound is an independent service and is not affiliated with, endorsed by, or sponsored by any marketplace it monitors (e.g. eBay, Vinted, Mercari, and others). Listings, prices, images, and seller information originate from those third parties; we do not control and are not responsible for their accuracy, availability, or your dealings with sellers. All third-party names and logos are the property of their respective owners and are used for identification only. You are responsible for complying with the terms of any marketplace you transact on.
4. Accounts and sign-in
You may register with an email and password or through a supported sign-in provider (Google, Apple, Facebook). You agree to provide accurate information and to verify your email where required.
5. Credits, purchases, and billing
- Credits. The Service runs on credits, which are consumed when checks and certain features run. Free credits may be provided periodically; additional credits may be purchased in packs or, where offered, via a subscription.
- Payments. Purchases are processed by third-party processors (Stripe, PayPal) or, in mobile apps, by the applicable app store (Apple, Google) (via RevenueCat). Your purchase is also subject to those providers' terms.
- Credits are not money. Credits have no cash value, are non-transferable, and are not redeemable except for Service features.
- No refunds. All purchases of credits and subscriptions are final and non-refundable, except where a refund is required by applicable law. If you are an EU consumer you normally have a 14-day right of withdrawal for digital purchases; by buying and choosing to use credits or a subscription immediately, you request immediate performance and acknowledge that you lose that right of withdrawal once the digital content or service has been supplied. Your mandatory statutory rights are not affected. App-store purchases may additionally be subject to that store's own refund process.
- Subscription cancellation. You may cancel a subscription at any time; cancellation stops future renewals and your access continues until the end of the current paid period. We do not provide partial-period or pro-rata refunds.
- Taxes. Prices may exclude applicable taxes, which you are responsible for.
6. Acceptable use
You agree not to: use the Service unlawfully or for prohibited goods; attempt to overload, probe, scrape, reverse-engineer, or circumvent limits or security of the Service; resell or provide the Service to third parties except as permitted; use it to infringe others' rights; or interfere with other users. We may set and enforce reasonable usage limits (including per-tracker and scan-frequency limits) and may suspend activity that threatens the Service or violates these Terms.
7. Your content
You retain rights to the configuration and content you submit (e.g. tracker keywords, prompts). You grant us a limited license to host and process it to operate the Service. You are responsible for ensuring you have the right to submit it.
8. Intellectual property
The Service, including its software, design, and the GrailHound name and logo, is owned by us or our licensors and protected by law. Except for the rights expressly granted, we reserve all rights. You may not copy, modify, or create derivative works from the Service without permission.
9. Third-party services
The Service integrates third-party services (sign-in, payments, AI, push, hosting, and the marketplaces). We are not responsible for third-party services and your use of them may be subject to their own terms and policies.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that notifications will always be timely, complete, or delivered.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAILHOUND ACCEPTS NO LIABILITY TO YOU FOR ANY LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH THE SERVICE — INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, MISSED OR UNSUCCESSFUL PURCHASES, OR LOST DATA — WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. The Service is a discovery and notification tool only; your dealings and transactions with any marketplace or seller are solely between you and that third party, at your own risk.
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any mandatory rights you have as a consumer. Where our liability cannot be wholly excluded, it is limited to the minimum extent permitted by law.
12. Indemnification
You agree to indemnify and hold GrailHound harmless from claims arising out of your misuse of the Service or violation of these Terms or applicable law, to the extent permitted by law.
13. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or as needed to operate the Service. Provisions that by their nature should survive termination will survive.
14. Changes
We may modify the Service or these Terms. If we make material changes, we will post the updated Terms here and update the "Last updated" date; continued use after changes take effect constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of Romania and applicable EU law, without regard to conflict-of-laws rules, and the competent courts of Romania will have jurisdiction over any dispute. Nothing in this section deprives a consumer of the protection of mandatory consumer-protection laws of their country of residence.
